The value of a personal injury claim can depend on much more than the injury itself. Earnings, services, care, treatment, future needs, pre-existing conditions and uncertain prognosis can all have a significant effect on the eventual value of a claim.

The law on damages is also moving. The Scottish Government has committed to a Damages (Scotland) Bill to implement the Scottish Law Commission’s recommendations on damages for personal injury, including reforms affecting services, deductions from damages, asbestos-related claims and the management of damages awarded to children.

This seminar will look at the principal heads of loss, the evidence required to value personal injury claims effectively and the changes now proposed to the law of damages.

The seminar will consider:

  • Solatium and the use of comparables
  • Judicial College Guidelines and Scottish authorities
  • Past and future earnings
  • Employability and disadvantage on the labour market
  • Pension loss
  • Services and the proposed changes to damages for services
  • Care and assistance
  • Treatment, rehabilitation and future care
  • Accommodation and future expenditure
  • Benefits, payments and deductions from damages
  • Pre-existing conditions
  • Future deterioration and uncertain prognosis
  • The evidence required to support different heads of loss
  • Damages involving children and proposed changes to the management of awards
  • Asbestos-related claims and the proposed reforms
  • Offers, negotiation and settlement
  • The Damages (Scotland) Bill and what the reforms could mean in practice
