Servitudes are a frequent source of difficulty in property transactions and disputes, particularly where rights are unclear, informal arrangements have developed over time, or long-standing use is being relied upon.
These issues often arise unexpectedly and can lead to delay, uncertainty and conflict between neighbouring proprietors if not handled properly.
This session looks at how servitude issues arise in practice and how to deal with them effectively when advising clients.

Stephanie is a Partner in Shepherd and Wedderburn's litigation and dispute resolution team specialising in property disputes, primarily in the rural and residential sectors as well as handling a number of real estate disputes. She also advises private clients in relation to a variety of contentious matters, including challenges to wills and neighbour disputes.
