Even apparently straightforward conveyancing transactions can throw up unexpected title problems. From discrepancies between the title and the property on the ground to historic deeds, missing rights and registration issues, knowing what requires further investigation — and what can safely be dealt with as part of the transaction — is an important part of day-to-day conveyancing practice.

This session will look at common title problems encountered in residential conveyancing and the options available to solicitors when dealing with them. Using practical examples, the seminar will consider:

  • When it is necessary to look behind the registered title
  • The continuing relevance of Sasine deeds and historic title
  • Discrepancies between the title sheet, title plan and property on the ground
  • Boundary and extent problems
  • Alterations and extensions not reflected in the title
  • Missing or inadequate rights of access, parking and services
  • Common areas and shared property
  • Defective deeds and questions of validity
  • Errors and omissions in the Land Register
  • When a problem needs to be resolved before settlement
  • Dealing with the Keeper and avoiding registration problems
  • Reporting title problems to clients and lenders
  • Practical options for resolving title difficulties
