Issues around repairs, dilapidations and insurance obligations are a common source of dispute in commercial leases, particularly as a lease comes to an end. What often seems straightforward at the outset can result in significant claims if the position isn’t properly understood.

For solicitors, the risk is in missing potential exposure early or not fully appreciating how these provisions operate in practice. This session looks at how these issues arise and what can go wrong, helping you advise clients more effectively and avoid costly surprises.

Topics covered are as follows:

  • The scope of repair obligations in commercial leases
  • How dilapidations claims arise and are assessed
  • Common issues at lease expiry
  • Interaction between repairs, reinstatement and insurance
  • Areas of dispute between landlords and tenants
  • Advising clients at the outset of a lease
  • Managing risk during the lease term
  • Common pitfalls and how to avoid them
  • Ken handles commercial property purchases, sales, development, loans, and leases for Scottish and international SME’s, development clients, and individual property investors.
