Commercial Dispute Resolution, including Commercial Litigation in the Courts, is a rapidly evolving practice area. The Court of Session established a Commercial Court as long ago as 1994 and most major Sheriff Courts have established their own commercial procedures. The procedures are fast track and involve pre action protocols and abbreviated pleadings. The procedures are case-managed and front-loaded. The Courts in Scotland if used appropriately are now well-adapted to swift and cost effective dispute resolution and Tim Edward, who has been practising in this area for over 25 years, will give an overview of how best the system might be used to give effective results for clients.
